Naya Rivera’s ex-husband Ryan Dorsey has reportedly filed a wrongful death lawsuit, following the Glee star’s death in July.
Naya, who is famed for playing Santana Lopez on the hit series, died, aged 33, after accidentally drowning at Lake Piru in California. She had rented out a boat with her five-year-old son Josey, who she shares with Dorsey.
Josey was found alone on the boat, prompting authorities to launch an extensive search for Naya. Her body was found in the lake five days later.
Four months after her death, Dorsey, along with Naya’s estate, is said to now be suing Ventura County, California, the United Water Conservation District and the country’s Parks and Recreation Management, reports US Weekly.
The publication claims paperwork submitted by Dorsey reveals he is seeking action on behalf of his son for Naya’s ‘wrongful death and negligent infliction of emotional distress’.
Dorsey claims that Naya’s death was preventable and argues the boat she had rented with their son Josey from Lake Piru did not comply with US Coast Guard safety standards.
The documents allege that the boat wasn’t properly equipped ‘with a safely accessible ladder, adequate rope, an anchor, a radio or any security mechanisms to prevent swimmers from being separated from their boats’.
They state that a later inspection revealed the boat didn’t have any flotation or life-saving devices – California law requires all pontoon boats longer than 16ft to carry flotation devices.
It’s also claimed that there were no signs at Lake Piru ‘warning of strong currents, low visibility, high winds, changing water depths, underwater caves, ledges, drop offs or trees, bush, and other debris congesting its waters’.
Naya was declared missing after her son Josey was found alone on a boat at Lake Piru on July 8. After Naya was found five days later, it was reported she had ‘mustered enough energy to save her son from the water but not herself’.
Following news of her death, tributes flooded in for Naya, with Glee’s creators Ryan Murphy, Brad Falchuk and Ian Brennan creating a college fund to support the star’s son.
Naya welcomed son Josey in September 2015 with Dorsey, a year after the pair tied the knot in Cabo San Lucas, Mexico.
They announced their split in December 2017 after nearly three years of marriage and the pair’s divorce was finalised a year later.
